Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Cafe Owner", "you", or "your") and Restrofi ("we", "us", or "our") regarding your use of the Restrofi restaurant management platform and services.

By accessing or using Restrofi, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

1. Customer Data Agreement

Critical: Customer Data Protection Obligations

As a cafe owner using Restrofi, you are entering into a binding agreement regarding the collection, storage, and use of customer data. This section outlines your legal obligations and responsibilities.

1.1 Data Collection Consent

By using Restrofi, you agree that:

  • You will only collect customer data that is necessary for processing orders and providing services
  • You have obtained or will obtain appropriate consent from customers before collecting their personal information
  • You will clearly inform customers about what data is being collected and how it will be used
  • You will comply with all applicable data protection laws and regulations in your jurisdiction

1.2 Fair Data Usage Commitment

You hereby commit to using customer data fairly and ethically:

Prohibited Uses

  • • Unsolicited marketing

1.3 Data Security Obligations

You agree to:

  • Maintain the security and confidentiality of your Restrofi account credentials
  • Implement reasonable security measures to protect customer data accessible through your account
  • Immediately notify Restrofi of any suspected security breaches or unauthorized access
  • Ensure that only authorized personnel have access to customer data
  • Comply with Restrofi's security guidelines and best practices

1.4 Data Retention and Deletion

You agree to:

  • Retain customer data only for as long as necessary for business operations or as required by law
  • Honor customer requests for data deletion in accordance with applicable data protection laws
  • Assist Restrofi in fulfilling customer data rights requests (access, rectification, erasure, etc.)
  • Regularly review and purge unnecessary customer data

1.5 Third-Party Data Sharing

You agree that:

  • You will not share customer data with third parties without explicit customer consent, except as required by law
  • Any third-party integrations you use must comply with data protection standards
  • You are responsible for ensuring that third-party services you integrate with Restrofi protect customer data appropriately
  • You will inform customers if their data is being shared with third parties and obtain consent where required

1.6 Legal Compliance

You warrant and represent that:

  • You will comply with all applicable data protection laws, including GDPR, PDPB, and local regulations
  • You have the legal authority to collect and process customer data in your jurisdiction
  • You will maintain necessary registrations or licenses required for data processing activities
  • You will cooperate with regulatory authorities in case of investigations or audits

2. Service Usage Terms

2.1 Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

2.2 Acceptable Use

You agree not to:

  • Use Restrofi for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any viruses, malware, or harmful code
  • Attempt to gain unauthorized access to Restrofi systems
  • Interfere with or disrupt the service
  • Use automated systems to access the service without permission

2.3 Subscription and Billing

Subscription fees, billing cycles, and payment terms are outlined in your subscription agreement. You are responsible for timely payment of all fees. Failure to pay may result in service suspension or termination.

3. Intellectual Property

All content, features, and functionality of Restrofi, including but not limited to software, text, graphics, logos, and icons, are owned by Restrofi and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use Restrofi for your business operations. You may not copy, modify, distribute, sell, or lease any part of our services.

4. Limitation of Liability

To the maximum extent permitted by law, Restrofi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Restrofi provides the service "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure.

5. Indemnification

You agree to indemnify, defend, and hold harmless Restrofi, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

  • Your use of Restrofi services
  • Your violation of these Terms
  • Your violation of any data protection laws or regulations
  • Your misuse of customer data
  • Any claims by customers regarding data handling

6. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to Restrofi services will be suspended
  • You must cease all use of the service
  • Data retention will be handled in accordance with our Privacy Policy
  • Outstanding fees remain due and payable

Restrofi reserves the right to terminate or suspend your account immediately if you violate these Terms or engage in any fraudulent, illegal, or harmful activity.

7. Changes to Terms

Restrofi reserves the right to modify these Terms at any time. Material changes will be communicated to you via email or through the platform. Your continued use of Restrofi after changes become effective constitutes acceptance of the modified Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].
